Agreement required
You have to agree to our terms of service before you can use our app “RUN, then app” or website “runtheapp.games”. By failing to agree or by disagreeing you are not allowed to use our products and/or services.

Introduction
RUN, the app is meant for fun and usage should be harmless at all times. As we can’t control who will use our app and/or our website, we have to lay down some ground rules. It comes down to this: “Have fun and play nice. If you can’t behave, we don’t want to play with you.” Below is the same but with a lot more details.

Terminology
RUN, the app (or “the app”): the app available in the Apple App Store and the Google Play Store
Website: the website runtheapp.games
RUN: The selection process done by the app to select a winner of a preset prize by an organizer
Organizer: A person or organization that has setup a RUN and a prize for the winner(s)
RUNner: a user who signed up for a RUN
Private RUN: RUNs that allow for 20 or less RUNners. These RUNs are free for the organizer.
Public RUNs: RUNs that allow for more than 20 RUNners. These RUNs have a maximum number of RUNners and the organizer needs to pay a fee depending on the maximum chosen.

Products and services
The products that are covered by this terms of service are the app “RUN, the App” and the website “runtheapp.games”. The services may contain any action from our side to facilitate in setting up and performing a RUN.

Intellectual property
RUN, the app as a whole, including the app and the website are considered valuable trade secrets and therefore we retain full ownership of all products and services related to RUN, the app. The software can be freely installed as app for RUNners to join public or private RUNs, but all parts of the software remain intellectual property of our company.

Copyright
It is not permitted to copy any part of RUN, the app, neither user interface, nor the source code without our written permission. If you like to do so you can contact us.

Organizers of public RUNs
Using RUN, the app as an organizer for a public RUN is a paid service. Once the first invoice for half the expected RUNners is paid the RUN can be created and made available for RUNner to join. After the RUN has taken place the second invoice will be paid, according to the payment terms, for the number of RUNners exceeding half the expected number of RUNners. The RUN must comply to the naming convention, stated below. The nature of the reward must comply to the rules for prizes, stated below.

As an organizer of a public RUN you agree to having the RUN mentioned on our social media (Instagram, Facebook, Twitter) and our website.

As an organizer you are not allowed to charge any fee or demand any service to RUNners for joining the RUN that you created or for the prize that you intend to give away.

Organizers of private RUNs
Usage of RUN, the app for organizers of RUNs for 20 users or less is free of charge and data of the RUNners will not be shared with the organizer, or any other person or organization. The RUN must comply to the naming convention, stated below. The nature of the reward must comply to the rules for prizes, stated below.

RUNners
Using RUN, the app as a RUNner is always free of charge! Neither our organization nor any organizer is allowed to charge any fee or demand any service whatsoever to allow anybody to join a RUN. If this is the case, please contact us. RUNners can only be natural persons and not businesses or any organization. Your username must comply to the naming convention, stated below. You are free to not accept any prize that you are given by any organizer, without any consequences whatsoever.

Rules regarding participation
To participate in a RUN, the person must be 18 and over. The organization of RUN the App may check this at any time and has the right to block an account in case of doubt. If the organization of RUN the App asks for legal identification, this must be provided and be complete and correct. In the event of forgery, the RUN the App organization can choose to report fraud.

Naming convention and profile pictures
For the names and pictures for RUNners, the RUNS, and organizers there are some commonsense restrictions. Names and pictures should serve only to identify RUNners or RUNs and should not be used with any other intention. It is strictly forbidden to enter a username or use a picture that resembles any existing person, other than yourself obviously, living or dead, fictitious or real. It is also not allowed to use a username or a picture that contains anything of a sexual, pornographic, violent, discriminatory, religious, political, hateful, or otherwise of a possibly offensive nature. Your account will not be accepted, and we will remove your account the moment we find out about it. Even when you have won a prize and your username and/or picture is found not to be qualified according to the above rules, your rights to this prize are forfeit and the RUN will be done again, but this time without you and another RUNner will be appointed winner by the system.

If you notice any RUNner, RUN, or organizer who does not comply to these rules for naming convention and/or profile pictures feel free to contact us and we will take the necessary steps to make the party at fault comply or we will remove the RUNner, RUN, or organizer from our system.

Payment terms
RUNs that need to include 50 or more RUNners require a payment as per the pricing on our website. These are called Public RUNs. Payment is done in two parts to mitigate financial risk for both our team and the organizer: the first invoice is for half the number of expected RUNners. After the first invoice is paid, the RUN can be set visible to allow RUNners to join. After the RUN has been completed the organizer will be invoiced for the total number of RUNners that were included, minus the value of the first invoice. Any discounts will be included to the second invoice. It is theoretically possible that any discount results in a negative second invoice, if this happens the second invoice will be zero.

Payment of any invoice should be done within 14 days from the invoice date. After expiry of these 14 days a reminder will be sent with a new due date of 7 days after the reminder invoice date. If the reminder is not paid within those 7 days, we will send out a claim, again with a due date of 7 days from its invoice date. Upon sending out this claim any discounts previously agreed to will be canceled and the full price of the public RUN will need to be paid, and regardless of the final number of RUNners that joined the maximum allowed RUNners will be invoiced. If the claim invoice is not settled within its 7 days term, we will send the claim to our external claims department and they will handle the claim going forward. This will lead to additional costs for the organizer of the RUN for the handling of the claim on top of the amount invoiced so far.

Rules for prizes
The organizer is obliged to actually offer the prize as set out in the RUN to the winner(s) that are assigned by RUN, the app. Prizes can never be any amount of money or gift cards of any kind. At making the RUN available for RUNners to sign up, it is not allowed to change the prize any longer. Any winner can choose not to accept the prize without further clarification and without further implications. Prizes can never be forced upon a winner. This holds true for both private and public RUNs. If the winner chooses to not accept the prize, the prize is not rewarded to anybody. No alternative prize can be offered to the winner without written approval from our organization. If the organizer wants to still award the prize but to another RUNner, a new RUN needs to be set up.

Our company is never responsible for the actual rewarding of the prize. If a RUNner needs to discuss about the prize, he or she has to turn to the organizer of that RUN, and never to our organization. RUNners are encouraged to report organizers that don’t award the prize that has been won. If any complaints come in about prizes not received, we will contact the organizer and if it is confirmed that the prize is not awarded the organizer will no longer be allowed to use our products or services from that moment on until the prize is actually awarded.

For both private and public RUNs there are restrictions to the nature of the prizes. A prize has to be something nice and rewarding for the RUNner. It may never be offensive or harmful emotionally, physically, or financially in any way to the winner. Especially for RUNners younger than 18 years.

Apple, Google, Microsoft, and RUN the App do not sponsor the organized RUNs. This means that these organizations do not give away the prizes and are not responsible for nor can be held accountable for prizes in any way, shape or form. The prizes are facilitated by the organizer of the RUN exclusively.

Disagreement
Our organization always has the right to stop or remove a RUN, public or private, when we think the RUN or RUNner is violating our rules. We always have the right to remove any RUNner or block people from joining. When we decide to stop a RUN we will contact the organizer. When we remove a RUNners we will contact the individual involved.

Privacy
Data shared with organizer will be mentioned to the RUNners upon entry of the RUN. We will never share your data with a third party without your persmission.

Updates to this Terms of Service
We have the right to change our terms of service and any time. Once we have updated the Terms of Service, we will inform all RUNners and organizers the next time they use the app.
